The criminal investigation into alleged forcible touching by former New York Gov. Andrew Cuomo hit a snag on Friday, with a judge granting a 60-day adjournment over paperwork issues, according to The New York Times and the Albany Times-Union.

In a letter to a city judge, Albany County District Attorney David Soares said the Albany County Sheriff's office did not include a sworn statement from the accuser in its criminal complaint, rendering it "potentially defective."

This comes after Cuomo was hit with a criminal complaint and summons over an alleged incident that occurred with a former staffer, Brittany Commisso, in the governor's mansion last year.

Cuomo has denied any wrongdoing.

As the news of the complaint broke in the last week of October, the Times-Union reported that it may have been issued prematurely. Albany County Sheriff Craig Apple also acknowledged during a press conference that he did not expect the complaint to get through city court as quickly as it did.

The Soares letter also included a reference to potentially "exculpatory" evidence that has been provided to the Cuomo legal team.

Soares described his office as being "in the middle" of its own investigation into Cuomo and said that the accuser's statement was not handled properly in the criminal complaint.

The DA described "a portion of a transcript of the victim's statement given in a separate proceeding, but that portion excluded an oath, and, even more troubling, excluded other portions of her testimony where she described the very same acts described in the complaint."
