Alex Jones' defense attorney called for a mistrial in his defamation damages trial on Thursday after it was revealed in a dramatic courtroom moment that he inadvertently sent a copy of Jones' entire phone contents to the opposing counsel.
Jones' attorney F. Andino Reynal asked Travis County District Judge Maya Guerra Gamble for a mistrial as the jury in the case continued deliberations.
Gamble turned down the request, saying "I don't think it's a mistrial based on this."
Reynal also filed for an emergency motion to protect the contents of Jones' phone that wound up in the possession of plaintiff attorney Mark Bankston, who is representing Sandy Hook parents suing Jones for defamation.
"We are very concerned about the records that have been disclosed, particularly the medical records," Reynal told Gamble as he asked that the plaintiff attorneys "return" all documents and "destroy" any they have.
Bankston called the motion for a mistrial a "fig leaf over his own malpractice."
